Ownership of Own Works
Unless expressly stated otherwise, the photographs, images and texts signed or attributed to Adrián Larcamón (who operates under the name Estudio El Mono Liso) are works of his authorship and are protected by Argentine Law 11,723 on Intellectual Property of the Argentine Republic from the moment of their creation, without need of registration, and by international copyright treaties.
The Author reserves all moral and patrimonial rights over such works. The mere viewing of the contents does not imply any cession of rights.
Purpose of Publications
The Author's photographic work is displayed on this site as a professional portfolio. The editorial content (the blog and writings about photography, authors and visual culture) is published for purposes of information, study, criticism, cultural dissemination and education, without profit motive with respect to third-party works that it may include.
Prohibited Uses
Except with prior, express, and written authorization from the Author, and without prejudice to legal exceptions, any reproduction, copying, downloading, distribution, publication, public communication, modification, transformation, or creation of derivative works based on any image or text, in whole or in part, by any means or procedure is prohibited:
- Reproduce, copy or download the works.
- Distribute, publish or publicly communicate the works.
- Modify, transform or create derivative works.
- Use the works for commercial or advertising purposes.
Unauthorized Use
Unauthorized use of the works constitutes an infringement of intellectual property rights and may give rise to the corresponding legal actions.
Third-Party Works and Right of Citation
The inclusion of photographs, reproductions or other material whose owner is a third party is carried out under the protection of the right of citation (article 10 of Law 11.723) and the limitations and exceptions of articles 27, 28, 31 and 36, using only the indispensable parts for educational, critical or cultural dissemination purposes.
It is clarified that the Argentine legal system does not contemplate a general clause of "fair use" or "just use" as the United States does: the exceptions are limited and subject to restrictive interpretation. When possible, the author, the holder of the rights and the source of each work are identified.
Right to One's Own Image
When photographs are exhibited in which identifiable persons appear, this is done with the consent of the person depicted (art. 53 of the Civil and Commercial Code; art. 31 of Law 11.723) or within legal exceptions: participation in public events; scientific, cultural or educational interest taking priority; or exercise of the right to report on matters of general interest.
Consent is revocable: any person depicted may request the removal or blurring of their image through the procedure described below.
Works in the Public Domain
When works in the public domain are reproduced, efforts are made to indicate this and maintain attribution to their original author, in respect of moral rights, which are perpetual.
Request for Content Removal
Any copyright holder or person with rights over their own image who believes that content on this site violates their rights may request its review or removal. To do so, write to adrian@estudioelmonoliso.com.ar indicating:
- Your contact details and the capacity in which you are making the claim (author, rights holder, or person depicted).
- The exact address (URL) where the content is located.
- The allegedly violated right (authorship, image, privacy, etc.) and the specific request (removal, attribution, blurring).
The Author will evaluate the claim and, if applicable, will remove or block the content within 7 (seven) calendar days from receipt of the notification. Removal does not imply acknowledgment of liability by the Author.
